No it does not. Read Article 132 section 5 D of the constitution. It says if after a month no Sec of Defense is nominated and the President is a veteran of Foreign Wars, with exemplary bravery in the battlefield and military expertise can act as one. I guess that means Obama, right ? No ? My bad.
