WINGNUT LEGAL ANALYSIS

Last night, Rusty Humphries claimed that Roe v. Wade was wrong because the Constitution gives the right to decide about abortion to the States. In his words, the Constitution states that powers not expressly granted to the federal government are "are reserved to the States." Humphries neglected to tell his listeners that there is much more to the Constitution than that single phrase:

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.


The immediately preceding amendment also has some bearing on this issue:

Amendment IX

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
