CATCH-22
The Supreme Court refused to hear an appeal of a case about illegal wiretapping, this letting the Appeals court ruling stand. The Appeals court ruled that the plaintifffs lacked standing because they could not prove that their conversations had been monitored. The good news is that 2 judges who explicitly ruled on the legality of the program both found that it was illegal.
