Plaintiffs are Drs. James L. Sherley and Theresa Deisher, Nightlight Christian Adoptions(“Nightlight”), Embryos, Shayne and Tina Nelson, William and Patricia Flynn, and ChristianMedical Association (“CMA”).
The Court found that the plaintiffs did not have standing and had this to say about one of the groups:
3. Embryos
Nightlight also seeks to proceed in this complaint on behalf of all embryos created for reproductive purposes that are no longer needed for such purposes. The complaint alleges that the embryos face the risk of imminent injury, i.e., destruction, as result of the NIH guidelines.
(Compl. ¶ 9.) The Court finds, however, that the embryos are not “persons” under the law, and therefore do not have standing.
