THESE ANALYSES ARE TROUBLESOME

Jon Eisenberg, the trial lawyer who won the recent illegal wiretapping case, thinks that the Obama Administration is worse than the criminal Bush regime on this very important 4th Amendment issue. Worse, Dave Lindorff at Counterpunch makes a good case that on several other issues, the Obama administration is no different and sometimes worse than the Bush regime. (h/t Ken Hoop)

If the Rule of Law is to have real meaning in America, then the Obama Administration will have to reverse course on these matters.

I have to say, there's one thing about this that I find pretty interesting. The thing is he's a constitutional scholar... and in the final analysis, their legality is not to be decided by him, but rather by the courts and congress... he's shown a propensity so far to have the three branches do their job, not have them done for them by the executive (cf- HCR, where he let congress do its stuff without interference for a long long time... and along the way let everybody see just who stood where on that issue). I suspect he's instructed the DoJ to follow the law as it stands... and is waiting for the courts and congress to either a) strike it down as blatantly unconstitutional or b) change the law around it. If the SC eventually rules... it will once again let people see just where the various justices stand on these issues.

I can't help but point out that the United decision has left certain justices in very bad odour among the citizenry at large... I think there is no question that Alito and Roberts at least are viewed very differently by the citizenry than they were five years ago, and United has a lot to do with that.

In short, he's trying to make them do their jobs and take responsibility for their decisions... which is an essential feature of your democracy. Both the courts and congress exist to limit the power of the executive... but that's meaningless if they don't actually do it, and instead depend solely on the good character of the president to make it happen.
