I noted below that one study estimated the additional cost of practicing defensive medicine simply to avoid a lawsuit may range from 5 percent to 9 percent of total health care costs. The CBO just came out with an analysis that puts this at 0.3 percent. This is still worth doing but it's not the silver bullet the wingers claim it to be.
